Q & A

E-2 Investor Visa

Q
What is an E–2 Investor Visa?

A

E-2 Investor Visa is a non-immigrant visa to the United States of America. It is only available to nationals of a “Treaty Country”

Q
Who is the E–2 Investor Visa for?

A

The E–2 Investor Visa is for investors & businessmen who are looking for a speedier entry to the U.S. It is ideal for those who want to do business in the U.S. but do not want to stay there permanently (hence avoiding worldwide taxes), and for those who are unsure if the U.S. will be their final destination.

Q
Can anyone apply for an E–2 Investor Visa?

A

No. Only citizens of “Treaty Countries” can apply for an E–2 Investor Visa, subject to certain criteria being met.

Q
Does one need an educational qualification or business experience to be eligible for E–2 Investor Visa?

A

No. There is no such specific requirement. You are only required to demonstrate that you have the necessary ability & skills to successfully run the business you are investing in.

Q
How much does one need to invest to qualify for an E–2 Investor Visa?

A

Unlike the EB-5 Investor Visa, there is no minimum E2 visa investment amount specified in law. The law only requires an investor to invest a “substantial amount”. The amount of investment would depend on the “type of business” one sets up or invests in. In addition, there are also certain rules laid down in law which help in determining whether one has satisfied the “substantial investment” criteria.

Q
What “types of business” can one invest in or set up?

A

Any legitimate and lawful for-profit business that will hire US workers & is expected to generate significant profit may qualify for an E–2 Investor Visa.

Q
Do I have to invest first before applying for an E–2 Investor Visa?

A

Yes. You have to invest in a U.S. business or establish a new business, at least to the point of being ready to start operations, before applying for an E–2 Investor Visa.

Q
How long does the U.S. government take to make a decision on an E–2 Investor Visa application?

A

Approximately 1–3 months
