L-1 Visa

The L-1 visa has two subcategories:

  • L-1A for executives and managers.
  • L-1B for workers with specialized knowledge.

The L-1A Non-Immigrant visa allows you to transfer an executive or manager from a company in your home country to a branch, subsidiary or affiliate of this company in the United States. You can also send an executive or manager to establish a new company in the US.

This is a temporary visa which allows for varying periods of stay and visa renewals, depending on whether you are sending your employee to establish a new company or to an existing company in the US.

Executives or managers who apply for this visa are allowed to take their spouse and unmarried children below the age of 21 years. Spouses may apply for work authorization in the US and can do any kind or work.

There is a pathway to permanent residency i.e. Green Card for holders of this visa.

EB-1C

The EB-1C visa is an immigrant visa i.e. a direct route to permanent residency (Green Card) in the United States. You are eligible for this visa if you are a multinational manager or executive. Both your US company employer and you must need certain criteria.

Executives or managers who apply for this visa are allowed to take their spouse and unmarried children below the age of 21 years. Spouses may apply for work authorization in the US and can do any kind or work.

No approved Labor Certification is required for this visa.

Requirements :

  • There must be a qualifying relationship between the US company & your company in a foreign country
  • The executive or manager you are transferring must have been working for the foreign company for at least 1 of the last 3 years in a managerial of executive capacity
  • The US company must have been doing business for at least 1 year before filing of the EB-1C visa
  • The US company must formally give a job offer to work in a managerial or executive capacity

 

Holders of L1A and E2 visas may be eligible to apply for this visa.

It is also possible to set up a new office in the US and transfer yourself to the US branch of your foreign company by using the L1A to EB-1C route.
